1. The promoter

The promoter (“Promoter”) is: KFIRIEL LTD trading under the name WinUHolidays of 563 Chiswick High Road, London W4 3AY, United Kingdom.

2. The competition

The title of the competition will be specified for each competition.

To participate in the competition, you will first need to test your expertise with a short game requiring you to use your skills, judgment and knowledge to set yourself apart from amateur participants. You will have to recognize landscapes pictures and indicate the corresponding country where it is located. To be eligible to win a prize, you must provide the right answer to each multiple-choice question you will be asked.

3. How to enter

The competition will run from a specified time on a specified date (the “Opening Date“) to another specified time on a specified date (the “Closing Date“) inclusive.

All competition entries must be received by the Promoter by no later than the time specified on the Closing Date of each competition. All competition entries received after the Closing Date are automatically disqualified.

To participate in the competition, enter the competition online by creating an online account and submitting the online entry form provided on [www.winuholidays.com] by Closing Date.

The Promoter will not accept:

Responsibility for competition entries that are corrupted, not successfully completed or transmitted, lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, website, computer hardware or software failure of any kind; or

Proof of posting or transmission as proof of receipt of entry to the competition.

By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

The competition entries will be judged by a software which will randomly draw the winner from the list of participants who gave correct answers to all the skill-based questions required to enter the competition.

4. Eligibility

The competition is only open to anyone aged 18 years or over, except:

Employees of the Promoter or its holding or subsidiary companies;

Employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

Members of the immediate families or households of (a) and (b) above.

In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.

The Promoter will not accept competition entries that are:

Automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);

Completed by third parties or in bulk;

Illegible, have been altered, reconstructed, forged or tampered with;

Photocopies and not originals; or

The number of entries to the competition per person can be limited and this will be specified in the terms and conditions specific to each competition. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

Competition entries cannot be returned.

Players from Germany are not allowed to participate due to legal restrictions.

5. The prize

The prize is a holiday, and if more than one prize, the number of prizes available to be won will be specified for each competition.

The details of the holiday prize (e.g. the number of people benefiting from the prize; the class of transport and type of carrier; the travel destination; the number of nights included in the prize and the dates of the holiday prize) will be specified for each competition. The travel dates are non-flexible. The prize does not include travel insurance, the cost of transfers to and from airports or stations, food and drink, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner(s).

You will be responsible for ensuring that you and any person travelling with you are available to travel without restrictions and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified.

Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value.

The prize is not negotiable and not transferable. Should the winner renounce to keep the prize, there will not be a new draw.

In order to claim the prize, you must answer the Promoter’s call announcing that you are the winner or call the Promoter back if you missed the call and then send a confirmation email to the Promoter to confirm in writing that you accept the prize.

The competition organizer reserves the right to change the flights and hotels to equivalent alternatives in case originally selected ones are unavailable

6 Winners

The decision of the Promoter is final, and no correspondence or discussion will be entered into.

The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.

The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winners and, if applicable, their winning entries in [instagram- Facebook- Tik-tok] on (Announcement Date).

In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

The Promoter will, subject to the obtention of the winner’s consent, use winners in post-event publicity. Such use can be, among other things, through photo, video or written testimony from winners.

7 Claiming the prize

If you are the winner of the prize, you will have 7 (seven) days from the Announcement Date to claim the prize by referring to the details of how to claim in condition 8. If you do not claim the prize by this date, your claim will become invalid.

The prize may not be claimed by a third party on your behalf.

The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available or has not claimed their prize within 7 (seven) days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

The Promoter does not accept any responsibility if you are not able to take up the prize.

8. Limitation of liability

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

9. Ownership of competition entries and intellectual property rights

All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

By submitting your competition entry and any accompanying material, you agree to:

Assign absolutely to the Promoter all your intellectual property rights held in the competition entry with full title guarantee; and

Waive absolutely all moral rights,

in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

You agree that the Promoter may, in their sole discretion, make your entry available on its website [www.winuholidays.com] and in any other media, whether now known or invented in the future, and in connection with any publicity of the competition.

10. Data protection and publicity

The Promoter will only process your personal information as set out in the privacy policy. See also condition 6.3 and condition 6.4, with regard to the announcement of winners.

11. General

If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
